Terms and Conditions

Living Journal (the “Service”) is operated by KN Digital Solutions LLC, a limited liability company organized in the State of Georgia, United States (“we”, “us”, or “our”). These Terms and Conditions (“Terms”) govern your access to and use of the Service, including our website, applications, and any related features.

By creating an account, checking the consent box at signup, or otherwise using the Service, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use the Service.

You must be at least 16 years old to create an account. By signing up, you confirm that you meet this requirement and that the information you provide is accurate and kept up to date.

Living Journal lets you record training sessions, programs, and templates, track progress over time, and (optionally) use an AI assistant to help plan and log workouts. Trainers may link to a client’s journal, with the client’s consent through the app, to view and help manage that client’s training data. We may add, change, or remove features at any time.

Living Journal, including anything generated by its AI coach, is provided for general informational and organizational purposes only. It is not medical, health, or professional fitness advice, and is not a substitute for guidance from a qualified physician, physiotherapist, or certified trainer.

You are solely responsible for evaluating your own physical condition and judgment before performing any exercise, and for consulting an appropriate professional before starting a new training program, especially if you have an injury, medical condition, or are otherwise at risk. You use the Service, and act on any suggestion it provides, entirely at your own risk.

The AI coach uses information from your journal (such as your goals, equipment, limitations, and logged sessions) to generate responses and can take actions in your journal that you ask for or confirm (for example, logging a set or creating a template). AI-generated content may be inaccurate or inappropriate for your situation — review anything it produces or changes before relying on it. Messages you send to the AI coach are processed by a third-party AI provider as described in our Privacy Policy.

You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Tell us promptly at support@dodson.me.uk if you suspect unauthorized use.

You retain ownership of the training data, notes, and other content you submit to the Service (“Your Content”). You grant us a worldwide, non-exclusive license to host, store, process, and display Your Content solely to operate, maintain, and improve the Service for you (and, where you’ve linked a trainer, for that trainer). You are responsible for Your Content and confirm you have the right to share it.

You agree not to:

• Use the Service for any unlawful purpose or in violation of these Terms;
• Attempt to gain unauthorized access to the Service, other accounts, or our systems;
• Probe, scan, or test the Service’s security without our prior written authorization;
• Interfere with or disrupt the Service, or impose an unreasonable load on our infrastructure;
• Scrape, reverse engineer, or build a competing product from the Service; or
• Use the AI features to generate content that is unlawful, abusive, or infringes others’ rights.

The Service is currently provided free of charge. If we introduce paid plans in the future, we will give you advance notice and the chance to accept new pricing terms before you are charged.

You may stop using the Service and request account deletion at any time by contacting support@dodson.me.uk. We may suspend or terminate your access if you breach these Terms, or discontinue the Service (or parts of it) with reasonable notice where practical.

The Service is provided “as is” and “as available”, without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that AI output will be accurate or suitable for your circumstances.

To the fullest extent permitted by law, KN Digital Solutions LLC and its officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, injury, or other harm arising from your use of, or inability to use, the Service — including any harm arising from following AI-generated guidance — even if we have been advised of the possibility of such damages. Our total liability for any claim relating to the Service will not exceed the amount you paid us, if any, in the 12 months before the claim arose.

You agree to indemnify and hold us harmless from any claims, losses, or expenses (including reasonable legal fees) arising from your misuse of the Service or violation of these Terms.

These Terms are governed by the laws of the State of Georgia, United States, without regard to its conflict-of-laws rules. Any dispute arising under these Terms will be subject to the exclusive jurisdiction of the state or federal courts located in Georgia, and you consent to that jurisdiction and venue.

We may update these Terms from time to time. If we make material changes, we will notify you (for example, by email or an in-app notice) before they take effect. Continuing to use the Service after changes take effect means you accept the updated Terms.
